One wonders why Mr. Bertarelli failed to consult his "best lawyers" in advance of accepting a challenge from a "yacht club" that had yet to hold a regatta. Would they not have informed him of the "technicality" that the judge found was in violation of the Deed of Gift? Really smart people get legal advice before they need it.

One also wonders what the evidentiary hearing might have shown on what constitutes a yacht club. A burning question left hanging.
