Perhaps I should clarify my thinking on the above statement..
The Deed calls for "friendly competition among nations" and that is SNG's (Alinghi's) duty - their fudiciary duty - to uphold.

If SNG do not meet their duty under the terms of the DOG then an interested party could ask the New York court to make a ruling on this. and the New York court could strip them of the Cup.

Yes it is Alinghi's choice to make to the extent in whether they choose to meet their legal obligations Personally I think it is to late for them to do so and it is only whether any interested parties are prepared to file a motion in the courts.

Doing so of course will give Brad Butterworth an additional opportunity to become inventive with his interpretation of events.

I don't think there is any doubt that Alinghi have crossed the line too many times. Imagine for a moment they prevail this time - who in their right mind would challenge them? It would be a wasted effort.

I am coming to the conclusion that the quickest way to get the America's Cup back on the water is to actually go Alinghi (SNG) in court for failure in there duty as trustees and then get a regatta going without any involvement from Alinghi ever again.

The best thing that could happen to the AC now would be for the "Close Encounters" space ship to land in Valencia and exchange Bertarelli & Ellison for Lipton & Mosbacher.
