Perhaps I should clarify my thinking on the above statement.. The Deed calls for "friendly competition among nations" and that is SNG's (Alinghi's) duty - their fudiciary duty - to uphold. If SNG do not meet their duty under the terms of the DOG then an interested party could ask the New York court to make a ruling on this. and the New York court could strip them of the Cup. Yes it is Alinghi's choice to make to the extent in whether they choose to meet their legal obligations Personally I think it is to late for them to do so and it is only whether any interested parties are prepared to file a motion in the courts. Doing so of course will give Brad Butterworth an additional opportunity to become inventive with his interpretation of events.
