America's Cup Delays Log-In to Post/Reply

The media are playing up PRO Harlod Bennet's postponements as yet more infighting between the two camps. With these two teams, we can't discount gamesmanship in any situation, but it seems a mistake to place Mr. Bennett in Alighi's pocket. Not making the schedule is unfortunate, but it isn't the worst that could happen.

I listened to an audio clip of his press conference. Speaking as a frequent PRO, I recognize his decisions as being based entirely on fairness and safety. What with venue, season, boats, courses & other parameters handed to him, he's been given an extremely difficult (Some would say insane.) challenge and is dealing well with it. If this America's Cup match has a hero, he's it.

Sometimes, the differences in perspecitve between racers and race officals aren't recognized: Racers want to win; officials don't care who wins but want to give no particular advantage to any team and have everyone come back safely from the course. No one should want a boat breaking up 40 miles offshore in difficult rescue conditions. It is, after all, merely a sporting event. If I were faced with the prospect of 50% of the fleet sinking during or before the race, I'd postpone too -- preferably ashore.

Some journalists asked what if the boats were different -- perhaps, sturdier and not as fast. I liked his answer, essentially, "They are what they are." Others asked about the course parameters; he acknowledged he could have safely set a five-mile course (probably with more marks to make the length) but it wasn't allowed. (Apparently, neither boat likes to turn.)

We might imagine referees calling off a football game because of lightning hitting the field. Or, stopping a basketball game because the rood is caving in. Even in a high-stakes game, delays are preferable to deaths.

An excellent post which sums up what is good about having an incorruptible human run the races, rather than inflexible documents from ancient history.
There were many hairy chested calls for the boats to be sent out in whatever conditions were present. Even calls for the start line to be set regardless of wind direction, strength or variation ("anywhere downwind will do").
The simple fact is that Harold Bennett will only do things the right way. He showed all due respect to the event itself.
He was the ice man in a crisis. He stuck absolutely to his own script despite being put under incredible pressure.
No one was going to get Harold to run a poor show. It was either right or it was not on. Very strong decision making on his part.
The Deed of Gift fails absolutely in so many areas, including the safety of competitors and the spectacle of fair racing. The chest beaters out there were just pushing their own barrows because of myopic team loyalties. They were completely out of touch.
In the end no one can complain about the AC 33 races. They were fair to both sides. The one sided result was not the fault of any Race Committee. Any potential for complaint was removed entirely from the event, as it should be, in every case.
The real complaint ought to be that the original Deed of Gift can still be used to run modern America's Cup competition at all. It should be quarantined out of the event in the nicest possible way, and with the greatest respect to George Schuyler.
The document was written at a time when we didn't even have telephones or electricity, yet alone diesel engines or aircraft.
If I can use an analogy, hereditary Monarchies still exist in the world, but they don't usually have absolute power these days. Modern Monarchs occupy suitably token positions that show great respect to their history, but allow the real hard work to be done by Parliaments.
America's Cup history is owed at least a fair and modern protocol that recognises the world in which we now live.

I totally agree with the fairness of AC 33. but.......

The Deed of Gift, however, has a very practical use as demonstrated twice in modern times. Once in 1988 where Michael Fey snuck a knife in to a fist fight and Dennis Connor shot him, and again in 33 where neither party could agree on anything and one party sought absolute control. The DoG served well in both instances to give the final ruling the competition would have otherwise been without. I think the Deed of Gift should be as sacred as the mug itself. The catharsis of the '88 DoG match spawned the IACC classs which did a yoman's job since. The legal debacle of 33, with a little luck will do the same. If the relative stability hangs in another 20+ years; all the hoop la will have served it's purpose. The DoG growls every time there is an America's cup contest. He had to bite in 33....

The next DoG match will be a hum dingger. How long can a two winged cat on computer controlled foils be?

Nicely put Mel,
The problem(s) with the 33rd America's Cup rests with the current participants. Personally I lay blame squarely at Ernesto Bertareli's feet.

The DOG is the safety net that returned us to sanity.

One positive out of the 33rd Cup is most issues have being tested in court now and any future DOG issues should have a precedent speeding any future disputes to resolution.

Before a race was run, I nominated PRO Harold Bennett for hero of the event. Now that both races are in the books, I'm more strongly in his corner. Seldom has a PRO shown more courage, or needed to.

I hope never to see a race committee mutiny on me, the way his did on St. Valentine's Day. But "Stalwart Harold" pushed forward and took charge, mustering irregulars into the corps to get the flags up & down and the guns fired. We need a Hall of Fame for race officials.

Exactly.... sir; the precedence was even, to a certain extent, set in the legal action in the DoG fight of 1988. As much as I hate legal maneuvering; when folks can't agree or compromise; when one's word is not enough; when logic and reason fail to prevail; it's good to be able to give the DoG his day.

Safety net? Practical? Sanity? Are we talking bout the Deed of Gift? Maybe I was tuned in to a different race?
3 years ago, there were 18 healthy syndicates in agreement about the proposed 33rd America’s Cup protocol. This followed the 32nd America’s Cup that was considered probably the best ever, with a live TV audience of 4 billion.
Sponsors were crawling over each other to get a piece of Number 33. It was going to be the biggest and best ever.
Then the Deed of Gift was invoked in a Court, slamming the door shut in the face of all but two of these syndicates and blowing away all their sponsors and public interest and support. It elevated the cost of campaigns, both Defender and Challenger to about half a $ billion, each, making a bunch of lawyers very rich along the way. It produced two ill matched freak boats that could only handle flat water and fluffy winter breeze without the risk of breaking up, and it attracted the staggering figure of just 200,000 viewers to the final event, streamed live on the internet. They couldn’t even give the TV rights away. Match racing was non existent. Public interest was almost zero.
If that is the Deed of Gift being a safety valve, or a lifeboat for America’s Cup then the event sure doesn’t need any further help, or it will simply disappear.
The Deed of Gift is an ancient document. It is like an 18th Century Queen, shouting “off with his head!” It just doesn’t make it in today’s world.
Let a representative of every Club that has won America’s Cup get together and write a new protocol that protects the interests of the Defender, the Challengers and the Public Interest. Retire the original Deed of Gift to a glass case. The event deserves far better protection and organisation than this document could ever have envisaged.

I can understand Will's strong feelings that (i) there shouldn't be DoG matches; (ii) there should be a multiteam event involving match racing; (iii) USA-17 and A5 were unmatched and unseaworthy "freak" boats; and (iv) it's all very bad for the AC's reputation. But, and as others have said:

- Alinghi/SNG/Bertarelli have repeatedly behaved disgracefully in an attempt to skew the race their own way. That did not start with the DoG challenge, but with A/S/B's attempt to convene a challenge with a non-qualifying club. One would think, normally, that a defender would be as keen as anyone on having a robust and evenhanded regatta - but A/S/B just weren't. The latest allegations of appalling behaviour by SNG officials - which make me think all the more highly of Harold Bennett - serve to underline just how broad and how deep the apparent objection to anything that might see A/B lose (again) ran. The DoG match - as with so many things that Will has complained over - was the necessary result of that attitude.

- There was, repeatedly, scope for A/S/B to agree to a multiteam regatta on fair terms. A/S/B didn't take it.

- A5 was a very limited boat with a narrow performance (and possibly safety) window - more fool them; BOR was, so far as we can tell, much more versatile and Will's contempt for the combined efforts of a really incredible group of sailors (and, sure, a huge amount of money and technology) seems misplaced, especially relative to all the deference and forbearance that A/S/B seem to get. In any case, it's too late to pretend that the AC - at least since Australia II - hasn't been a battle of money, guile and technology. It's not a conventional single class race and it would be a great shame if it were to become one - not that that is at all likely with Coutts involved.

- I agree that the DoG matches didn't make for good television match coverage. It did, though, make for absolutely fantastic media coverage of just what a sailboat can do - I have no idea how many news outlets ran clips of USA-17 on a single ama, but am quite sure that this event, and the result, has left more people worldwide stunned both by how fast USA-17 could go and in how little wind than any previous event, whether AC or multihull. That may well not satisfy the specialist, but it's hardly all downside.

As to the future, and also just so as to throw A/S/B's conduct into sharp perspective, Ellison has said, immediately, that there will now be independent management, independent juries and so forth.

Will, you keep putting the cart before the horse.

The DoG SAVED the America's Cup from a complete hijacking by SNG. Your continual references to the halcyon days of AC32 is out of touch with reality. If SNG had their way with AC33, the America's Cup would have ceased to exist - forever. Instead we would have the Alinghi Cup, where the defender dictates everything to the challengers all for the defender's financial benefit.

Absolutely Peter! Indeed in my legal investigation I find the Deed of Gift to be legally binding and the fact that it is, legally a "charitable trust" makes it not only legally binding but almost impossible to circumvent without agreement on two sides. Eliminating it as the backbone of the America's Cup requires a set of circumstances that can (practically) never happen. Past AC successes have nothing to do with the glaring difference in this event. Study, and I mean STUDY the legal arguments on both sides of 33 and it becomes easy to see both what happened in this event, who was at fault and how the Deed of Gift literally saved the Cup. The DoG, in most all respects, saved the cup in '88 and again here.

If we look further back into history; it can be argued that the New York Yacht Club was occasionally as heavy handed as SNG and it well may be that the Dog was the only thing that lightened their trophy room of 90 Gunnies worth of plated silver bottomless cup.

It's easy to point at how this event was a mess; how it eliminated much of the interest that normally surrounds the Cup; how technology ruined the competition and so on and on but the Deed of Gift was written such that it ultimately underpins the Cup and allows, indeed forces, uncompromising men to compete.......

The 33rd DOG match may not be the event we all hoped for, but the Alinghi Cup event Ernesto had planed wasn't either. Due to the intervention of the DOG the 34th event is at least at this early stage looking very promising.

I think I may patent a Tee Shirt with "HAIL THE DOG" or "DOG POWER" "Scuttlebutts bow to the DOG"
Any other suggestions out there?

Yes the Dog saved the America's Cup, but it was really only the tools available for BOR to use, once again thanks for your tenacity Larry.
